TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of the Nyaysopan mobile application and related services (collectively, the "Platform"), operated by Gohiggler Private Limited ("Company", "we", "us", "our"), a company registered in India.
By downloading, installing, accessing, or using the Platform, you agree to be legally bound by these Terms. If you do not agree, you must not use the Platform.
1. About Nyaysopan
1.1 Platform Overview
Nyaysopan is an online marketplace that connects:

Lawyers who provide paid legal consultations, document review, document signing, and chat/voice-based legal assistance.

Users/Clients ("Users") who seek legal consultations via in-app voice and chat.
-
Students who access educational and informational content free of charge.
1.2 Not a Law Firm
The Company is not a law firm, does not provide legal advice, and does not engage in the practice of law. All legal services are provided independently by registered lawyers. No attorney-client relationship is created between any user and the Company.
1.3 Independent Professionals
Lawyers on the Platform are independent professionals. The Company does not supervise, direct, or control the quality, timing, or legality of any legal advice, nor does it guarantee any particular outcome.
1.4 Compliance
The Platform is designed to comply with:

Applicable Indian laws, including the Information Technology Act, 2000 and Digital Personal Data Protection principles.

App store policies including Google Play Developer Program Policies and Apple App Store Review Guidelines.

Professional regulatory requirements, including Bar Council of India rules.
2. Eligibility and Account Registration
2.1 Eligibility
To use the Platform, you must:

Be at least 18 years of age and legally capable of entering into binding contracts.

Lawyers must be duly enrolled with a recognized State Bar Council in India and authorized to practice law.

Students must provide valid academic credentials where required.
2.2 Account Creation
You must create an account to access certain features. You agree to:

Provide accurate, current, and complete information during registration.
-
Maintain and promptly update your information.
-
Keep your login credentials confidential.
-
Accept responsibility for all activities under your account.
2.3 Account Security
You must notify us immediately at admin@gohiggler.com if you suspect unauthorized use of your account. We are not liable for losses arising from unauthorized access due to your failure to safeguard credentials.
3. Lawyer Verification and Onboarding
3.1 Required Information
Lawyers must submit accurate and complete information, including:

Personal details (name, date of birth, email, phone).

Professional credentials (Bar Council ID, enrollment number, years of practice, specialization).

Office and chamber details.
-
Identity documents (Aadhaar, Advocate ID, Vakalatnama, PAN).
-
Optional: portfolio, certificates, and supporting documents.
3.2 Verification Process
We may verify credentials using internal checks, third-party services, or publicly available records. We may perform periodic re-verification. You authorize such verification to the extent permitted by law.
3.3 False Information
Providing false, misleading, or outdated information may result in immediate account suspension or termination.
4. User and Student Information
Users and Students may be required to provide:

Identity and verification documents (Aadhaar, PAN, academic records, mark sheets).

Contact details (email, phone number).

Optional profile and address information.
This information is collected for identity verification, fraud prevention, regulatory compliance, and platform safety, as detailed in our Privacy Policy.
5. Services and User-Generated Content
5.1 Platform Features
The Platform facilitates:

One-to-one voice and chat consultations between Users and Lawyers.

Document upload and sharing for legal review.

Educational content for Students.
5.2 User-Generated Content (UGC)
"User-Generated Content" includes any content you upload, transmit, or create through the Platform, such as:

Profiles, photos, descriptions, credentials.
-
Messages, call content, reviews, feedback, documents.
5.3 Your Responsibility
You are solely responsible for your UGC. You represent and warrant that:

You have all necessary rights and permissions to share the content.
-
Your content is accurate, lawful, and does not infringe third-party rights.
-
Your content does not contain confidential or privileged information you are not authorized to disclose.
5.4 Prohibited Content and Conduct
You agree not to use the Platform to:

Violate any law, regulation, or court order.
-
Engage in harassment, bullying, hate speech, threats, or violence.
-
Promote or engage in fraud, scams, impersonation, or identity theft.
-
Share obscene, sexually explicit, defamatory, or otherwise inappropriate content.

Upload malware, viruses, or harmful code.
-
Misrepresent your identity, qualifications, or affiliations.

Solicit or promote illegal activities or services.
-
Share false or misleading professional credentials.
6. Contact Information Sharing and Off-Platform Communication
6.1 Strict Prohibition
To protect platform integrity and user safety, all users are strictly prohibited from sharing or requesting personal contact information, including:

Phone numbers

Email addresses
-
Social media handles
-
Physical addresses
-
Messaging app IDs (WhatsApp, Telegram, Signal, etc.)
This prohibition applies before, during, and after all interactions on the Platform.
6.2 Off-Platform Transactions
You must not use the Platform to arrange or encourage off-platform communication or transactions that bypass Platform systems, except where expressly permitted by the Company.
6.3 Automated Monitoring
The Platform uses automated analysis of voice and chat communications to detect violations, fraud, and prohibited conduct. This monitoring is used strictly for security, fraud prevention, dispute resolution, and legal compliance, as described in our Privacy Policy.
7. Reporting, Blocking, and Moderation
7.1 In-App Reporting
You may report:

Objectionable or abusive behavior.

Suspected fraud or impersonation.
-
Sharing of contact information.
-
Other violations of these Terms.
7.2 Blocking
Users may block other users (including Lawyers) to prevent further direct communication.
7.3 Our Moderation Rights
We may, at our sole discretion and without prior notice:

Review reported content and accounts.

Remove or restrict access to content.
-
Suspend or terminate accounts.
-
Cooperate with law enforcement.
-
Take any action necessary to protect users, comply with laws, or enforce these Terms.
7.4 Response Time
We aim to review serious reports within 24-48 hours. However, response times may vary based on report volume and complexity.
8. Payments, Fees, and Refunds
8.1 Consultation Payments
Users pay Lawyers for consultations through integrated payment methods. Rates, fees, and billing methods are displayed in the Platform.
8.2 Lawyer Onboarding Fees
Lawyers may be required to pay a one-time, non-refundable onboarding or registration fee to access Platform services. Fee details are provided during onboarding.
8.3 Payment Processing
Payments are processed through:

Integrated third-party payment gateways.
-
Platform billing systems compliant with applicable app store policies.
-
Other methods approved by the Company.
Where required by app store policies (Google Play, Apple App Store), in-app purchases may be processed through the respective store's billing system.
8.4 Earnings and Payouts (Lawyers)

Lawyers earn based on consultation time as defined in the Platform.

Payouts are subject to verification, compliance checks, and internal review.

We may withhold or reverse payouts in cases of disputes, violations, fraud, or regulatory obligations.
8.5 Taxes
You are responsible for all applicable taxes arising from your use of the Platform and transactions. We may withhold taxes where required by law.
8.6 Refunds
Refund eligibility is governed by:

Platform refund policies communicated in-app.

Applicable consumer protection laws.

App store refund policies where applicable.
9. No Guarantees
9.1 No Guarantee of Legal Outcomes
The Company does not guarantee any particular legal outcome, result, quality of advice, or resolution. All interactions occur at your own discretion and risk.
9.2 No Guarantee of Clients or Income (Lawyers)
The Company does not guarantee:

Minimum number of consultations.
-
Minimum income or earnings.
-
Any particular type or volume of clients.
Success depends on market demand, specialization, user ratings, and performance.
10. Intellectual Property
10.1 Platform Ownership
All rights, title, and interest in the Platform (including software, design, trademarks, logos, and Company-created content) are owned by or licensed to Gohiggler Private Limited. You receive a limited, non-exclusive, non-transferable license to use the Platform for its intended purposes, subject to these Terms.
10.2 User Content License
By submitting UGC, you grant the Company a worldwide, non-exclusive, royalty-free license to:

Use, store, reproduce, modify, display, and transmit your content.

Operate and provide the Platform and services.
-
Enforce these Terms and our policies.
-
Comply with legal obligations.
We do not claim ownership of legal work product between Lawyer and Client, except as necessary to operate the Platform and for legal, security, and backup purposes.
10.3 Trademark Policy
"Nyaysopan" and associated logos are trademarks of Gohiggler Private Limited. You may not use our trademarks without prior written permission.
11. Third-Party Services and Links
The Platform may integrate with or link to third-party services (payment processors, analytics providers, cloud storage, etc.). We are not responsible for third-party practices, and their own terms and privacy policies apply. You should review them before interacting.
12. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW:

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis.

We make no representations or warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, or non-infringement.

We do not warrant that the Platform will be uninterrupted, secure, or error-free, or that defects will be corrected.

We do not guarantee the accuracy, completeness, or quality of any content, advice, or information provided by Lawyers or other users.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
13.1 No Liability for Legal Services
The Company is not liable for:

Legal outcomes, advice quality, or professional conduct of Lawyers.

Disputes between Lawyers and Users.
-
Any loss, damage, or harm arising from legal consultations or services obtained through the Platform.
All legal services are provided independently by Lawyers. All interactions occur at your own discretion and risk.
13.2 Limitation of Damages
The Company, its directors, officers, employees, and agents will not be liable for any:

Indirect, incidental, special, consequential, or exemplary damages.

Loss of profits, revenue, data, goodwill, or business opportunities.
-
Damages arising from unauthorized access, data breaches, or technical failures.
13.3 Maximum Liability
Our total aggregate liability for any claim shall not exceed the greater of:

(a) The total fees you paid to us in the three (3) months preceding the claim; or
-
(b) INR 5,000 (five thousand rupees) or equivalent.
13.4 Applicable Law
Nothing in these Terms limits any liability that cannot be excluded or limited under applicable law, including liability for fraud, gross negligence, or willful misconduct.
14. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its affiliates, directors, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from:

Your use or misuse of the Platform.

Your breach of these Terms or any applicable law.

Your UGC or any content you submit.
-
Any dispute between you and another user.
-
Your provision or receipt of legal services through the Platform.
15. Suspension and Termination
15.1 Termination by Company
We may suspend or terminate your account and access at any time, with or without notice, if:

You violate these Terms or our policies.
-
We are required to do so by law, court order, or regulatory authority.
-
Your conduct poses a risk to other users, the Platform, or our business.
-
Technical, security, or operational reasons require it.
15.2 Termination by You
You may terminate your account at any time through in-app settings or by contacting us at admin@gohiggler.com.
15.3 Effect of Termination
Upon termination:

Your right to use the Platform immediately ceases.
-
We may retain certain data as described in the Privacy Policy and as required by law.

Provisions that by their nature should survive (including intellectual property, limitation of liability, indemnity, and dispute resolution) will continue to apply.
15.4 No Refunds on Termination
Onboarding fees, subscription fees, and other payments are generally non-refundable upon termination, except as required by law or our refund policy.
16. Governing Law and Dispute Resolution
16.1 Governing Law
These Terms are governed by the laws of India, without regard to conflict of laws principles.
16.2 Jurisdiction
Subject to the arbitration clause below, the courts of Udaipur, Rajasthan, India shall have exclusive jurisdiction over any disputes arising from these Terms or the Platform.
16.3 Arbitration (Optional)
The parties may mutually agree to resolve disputes through binding arbitration under the Arbitration and Conciliation Act, 1996, with arbitration to be conducted in Udaipur, Rajasthan, India, in English.
17. Changes to These Terms
We may update these Terms from time to time. Material changes will be communicated via:

In-app notification.

Email to your registered address.

Posting on our website.
Your continued use of the Platform after the effective date of changes constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Platform.
18. Severability and Waiver
18.1 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
18.2 Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
19. Entire Agreement
These Terms, together with our Privacy Policy and any additional policies referenced herein, constitute the entire agreement between you and the Company regarding the Platform, superseding any prior agreements or understandings.
